IN CONSIDERATION OF the risk of injury that exists while participating in WHEELER WILDCATS YOUTH FOOTBALL & CHEER, A DIVISION OF COBB FOOTBALL LEAGUE, SPRING TRAINING (hereinafter the "Activity").

IN CONSIDERATION OF my desire for ______________________________________________________________ (“Participant”) to participate in said Activity and being given the right to participate in same;

The Undersigned hereby on behalf of Participant, (hereinafter collectively, “Releaser,” "I" or "me", which terms shall also include Releaser’s parents or guardian if Releaser is under I8 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of Participants participation in the Activity, and

THE UNDERSIGNED HEREBY releases and forever discharges WHEELER WILDCATS YOUTH FOOTBALL & CHEER, A DIVISION OF COBB FOOTBALL LEAGUE located at  WHEELER HIGHSCHOOL AND OTHER COBB COUNTY SCHOOL DISTRICT SYSTEM FACILITIES  their affiliates, coaches, managers, members, agents, attorneys, staff, volunteers, heirs representatives, predecessors, successors and assigns (collectively 'Releasees"), from any physical or psychological injury that Participant may suffer as a direct result of my participation in the aforementioned Activity.

PARTICIPANT IS VOLUNTARILY PARTICIPATING IN THE AFOREMENITONED ACTIVITY AND IS PARTICIPATING IN THE ACTIVITY ENTIRELY AT THEIR OWN RISK. THE UNDERSIGNED IS AWARE OF THE RISKS ASSOCIATED WITH PARTICEPATLNG IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT IS NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, CONCUSSION, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), MOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM PARTICIPANT’S OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED IO TRAVEL TO AND FROM THE ACTIVITY, OR FROM CONDITIONS AT THE ACTIITIY LOCATION(S). NONETHELESS, THE UNDERSIGNED ASSUMES ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN FOR PARTICIPANT’S PARTICIPATION IN THIS ACTIVITY.

THE UNDERSIGNED FURTHER AGREES to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs.

THE UNDERSIGNEDFURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or fillies to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that Participant should require medical care or treatment, THE UNDERSIGNED authorizes ___________________________________________________________ (“Name of medical facility”) to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. UNDERSIGNED further agrees to assume all costs involved and agrees to be financially responsible for any costs incurred as a result of such treatment. UNDERSIGNED is aware and understands that UNDERSIGNED is responsible for Participant’s own health insurance.

THE UNDERSIGNED FURTHER ACKNOWLEDGES that this Activity may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. THE UNDERSIGNED agrees not to allow Participant to participate in the Activity unless the Participant is medically able and agrees to abide by the decision of the Director or Head Coach regarding approval to participate in the Activity.

THE UNDERSIGNED HEREBY ACKNOWLEDGES THAT THEY HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTANDS THAT IT IS A RELEASE OF FULL LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE RELEASEES,  ANY AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATIORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND AGREE TO VOLUNTARILY GIVE UP OR WAIVER ANY RIGHT THAT OTHERWISE THE UNDERSIGNED WOULD HAVE TO BRING A LEGAL ACTION AGAINST RELEASEES FOR PERSONAL INJURY OR PROPERTY DAMAGE.

To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Releasees, its agents, and employees.

THE UNDERSIGNED agrees that this Release shall be governed for all purposes by Georgia law without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements.

In the event that any damage to equipment or facilities occurs as a result of my or my family's or my agent's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.

The Undersigned further acknowledges and agrees to the Media Release terms below:

1.  The Undersigned grants permission to Releasee to use the Participant’s photographs in publications, both print and digital forms, including the Wheeler Wildcats Youth Football & Cheer website, newsletters, emails, social media posts, videos, brochures, and advertising for events related to Releasee.

2.  The Undersigned consents to the use of Participant’s photographs by any third party in whole or in part, in all forms and media for distribution to the general public for the purpose of publicity and Promotion of Wheeler Wildcats Youth Football & Cheer.

3.  In giving this consent, the Undersigned releases Releasee any all third parties from liability for any violation of any personal or proprietary right the Undersigned may have in connection with any sale, reproduction or use of their photographs.

4.  The Undersigned certifies that they are 18 years of age or older.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF PARTICIPANTS PARTICIPATION IN THE ACTIVITY DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.
